Disposition of state property

Disposal of property, owned by the Republic of Belarus under the economic jurisdiction of RUE "Minskenergo", as well as the acceptance of property onto the balance sheet of RUE Minskenergo is carried out in accordance with the following basic regulatory legal acts:

1. Civil Code of the Republic of Belarus dated 7 December 1998 Mr. №218-3;
2. Decree of the President of the Republic of Belarus dated 19 September 2022 Mr. № 330 "On the disposal of property";
3. Resolution of the Council of Ministers of the Republic of Belarus dated 14 november 2019 Mr. № 767 “On the procedure for preparing draft decisions on the disposal of property, as well as on its acquisition into the ownership of the Republic of Belarus";
4. Decree of the President of the Republic of Belarus dated 23 november 2017 Mr. № 7 "On the development of entrepreneurship";
5. Regulations on the procedure for the formation and updating of the state information resource “Unified Register of Property, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 20 november 2020 Mr. № 667 “On measures to implement the Decree of the President of the Republic of Belarus dated 18 May 2020 Mr. № 168».

Acceptance of property on the balance sheet of RUE "Minskenergo" (fixed assets, goods in circulation) and engineering facilities, transport, social infrastructure and their improvement, completed construction, but not registered in the established manner as real estate objects from third-party organizations and individual entrepreneurs is carried out in accordance with the following regulatory legal acts:

7. Decree of the President of the Republic of Belarus dated 30 May 2023 Mr. № 155 "On gardening partnerships";
8. Decree of the Ministry of Economy of the Republic of Belarus dated 30 September 2011 Mr. № 161 "On the establishment of standard service life of fixed assets and the invalidation of certain resolutions of the Ministry of Economy of the Republic of Belarus";
9. Heat supply rules, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 11 September 2019 Mr. № 609;
10. Power supply rules, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 17 October 2011 Mr. № 1394;
11. Regulations on the procedure for admission (transmission) to the balance of heat supply facilities, approved by the order of the State Economic Plan of the Republic of Belarus, Ministry of Energy of the Republic of Belarus and Ministry of Housing- municipal services of the Republic of Belarus from 2 March 1994 Mr. № 21/14/14;
12. Decree of the Ministry of Architecture and Construction of the Republic of Belarus dated 29 April 2011 Mr. № 13 "On the establishment of forms of primary accounting documents in construction";
13. Instructions for accounting of fixed assets, approved by the resolution of the Ministry of Finance of the Republic of Belarus dated 30 April 2012 Mr. № 26;
14. Instructions on the procedure for determining the cost of a construction project in accounting, approved by the Decree of the Ministry of Architecture and Construction of the Republic of Belarus dated 14 May 2007 Mr. № 10;
15. Resolution of the Ministry of Finance of the Republic of Belarus dated 22 April 2011 Mr. № 23 "On the establishment of forms of the act of acceptance and transfer of fixed assets, the act on acceptance and transfer of intangible assets and approval of the Instructions on the procedure for filling out the act on acceptance and transfer of fixed assets and the act on acceptance and transfer of intangible assets";
16. Technical Code of Good Practice TCH 52.7.01-2020 (33520) "Assessment of the value of objects of civil rights. The procedure for assessing the value of property, owned by the state", approved by the resolution of the State Property Committee of the Republic of Belarus dated 30 December 2020 Mr. № 29.

Leasing and transfer of property for gratuitous use, under the economic control of RUE Minskenergo, carried out in accordance with the following regulatory legal acts:

17. Decree of the President of the Republic of Belarus dated 16 May 2023 Mr. № 138 “On rent and free use of property”;
18. Regulations on the procedure for holding auctions for the sale of the right to conclude lease agreements for capital structures (buildings, facilities), isolated premises, parking spaces, their parts, state-owned, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 08 August 2009 Mr. № 1049 “On holding auctions for the sale of the right to conclude lease agreements”;
19. Regulation on the procedure for compensation by tenants (borrowers) maintenance costs, exploitation, repair of rented (donated for free) real estate, sanitation costs, utilities and other services, approved by the Resolution of the Council of Ministers of the Republic of Belarus dated 7 June 2018 Mr. № 433;
20. Resolution of the Council of Ministers of the Republic of Belarus dated 30 April 2013 Mr. № 327 “On approval of the list of public organizations (associations), and their organizational structures, funds, associations of legal entities and (or) individual entrepreneurs (associations and unions), in respect of which, when leasing real estate, a reduction factor is applied to the base rates 0,1 and recognizing as invalid some resolutions of the Council of Ministers of the Republic of Belarus”;

Involvement of unused and inefficiently used property into economic circulation, located in republican ownership and assigned to RUE "Minskenergo" with the right of economic management, carried out in accordance with the following regulatory legal acts:

21. Resolution of the Council of Ministers of the Republic of Belarus dated 13 november 2019 Mr. № 763 "On the involvement in the economic turnover of unused and inefficiently used property";
22. Resolution of the Council of Ministers of the Republic of Belarus dated 10 February 2011 Mr. № 173 "On some measures to implement the Decree of the President of the Republic of Belarus dated 6 August 2010 Mr. №410» (together with the Regulations on the procedure for conducting an assessment reliability assessment);
23. Resolution of the Council of Ministers of the Republic of Belarus dated 11 March 2010 Mr. № 342 “On auctions for the sale of state-owned real estate with the establishment of a starting price, equal to one basic value";
24. Decree of the State Committee for Property of the Republic of Belarus dated 22 October 2019 Mr. № 13 "On the formation of a list of unused and inefficiently used property".

Write-off of property, owned by the Republic and secured on the right of economic management by RUE "Minskenergo", carried out in accordance with the Resolution of the Council of Ministers of the Republic of Belarus dated 13 november 2019 Mr. № 764 “On the write-off of property, owned by the Republic of Belarus" (together with the "Regulations on the procedure for writing off property, owned by the Republic of Belarus").
